Bivia Terms of Use and End User License Agreement

Effective date: June 1, 2026

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of Bivia, including the Bivia mobile application, related content, features, subscriptions, websites, support channels, and services (collectively, the "Service").

The Service is provided by Higor Rodrigues Torres da Silva ("Bivia", "we", "us", or "our").

By downloading, accessing, subscribing to, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Educational Purpose Only

Bivia is an educational study tool designed to help users learn and review veterinary anatomy and related health and life science topics through lessons, flashcards, image-based questions, quizzes, spaced repetition, progress tracking, and related study features.

Bivia is not a medical device, veterinary medical device, diagnostic tool, treatment tool, clinical decision support system, or substitute for professional education, judgment, diagnosis, treatment, supervision, or advice.

The Service does not provide veterinary diagnosis, medical diagnosis, treatment recommendations, drug dosage recommendations, emergency guidance, patient-specific clinical advice, or professional veterinary services. You must not rely on Bivia to diagnose, treat, monitor, or manage any animal, patient, disease, injury, or health condition.

Always consult a qualified veterinarian, physician, professor, institution, or other appropriate professional before making educational, clinical, treatment, animal care, or professional decisions.

2. Eligibility and Accounts

You may use the Service only if you can form a binding agreement with us or if your parent or legal guardian has reviewed and accepted these Terms on your behalf.

Some features may require an account. You may create or access an account using email and password, Sign in with Apple, Google sign-in, or other authentication methods we make available.

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and not to impersonate another person or create accounts for abusive, fraudulent, or unlawful purposes.

You may request account deletion from within the app where available or by contacting suporte@getbivia.com. Account deletion may remove or disable access to study progress, preferences, and other account-linked data. Subscription cancellation is handled separately through Apple, Google, or the applicable app store, as described below.

3. Free Features and Bivia Pro

Bivia may offer free features with limits, including limited reviews, lessons, or access to selected content.

Bivia Pro is a paid subscription that may unlock additional functionality, such as unlimited reviews, offline study, additional lessons, premium study flows, and other paid features described in the app or on the purchase screen.

Features, lessons, decks, question sets, language availability, and content may change over time. We may add, update, reorganize, correct, remove, or discontinue content where reasonably necessary to improve the Service, correct errors, comply with law, or maintain quality. If you have an active paid subscription, we will not intentionally remove the core paid functionality without providing a reasonable substitute, unless required by law, platform policy, security, or technical necessity.

4. Subscriptions, Auto-Renewal, Billing, and Cancellation

Bivia Pro may be offered as an auto-renewable subscription, such as monthly or annual plans. Subscription names, prices, periods, trials, promotional offers, and included features are shown before purchase in the app and through the applicable app store purchase sheet.

If you purchase a subscription through the Apple App Store:

If free trials, introductory offers, promotional offers, or grace periods are available, their details will be displayed before purchase or provided by the app store. At the end of a free trial or promotional period, your subscription may automatically convert to a paid subscription unless canceled according to the applicable app store rules.

We may use third-party subscription infrastructure, such as RevenueCat, to validate purchases, restore purchases, manage entitlements, and provide subscription access. You must not attempt to bypass, tamper with, reverse engineer, or interfere with purchase validation, entitlement checks, or app store billing.

5. Restore Purchases

If you purchase Bivia Pro through an app store, you may be able to restore purchases using the restore purchase option in the app or through the app store. Access to paid features depends on successful validation of the purchase and the current status of your subscription.

6. No External Purchase Requirement

Digital features and subscriptions consumed inside the iOS app are offered through Apple's in-app purchase system unless a specific app store policy or entitlement allows otherwise. The app will not require you to use an external purchase method to unlock digital content or functionality inside the iOS app.

7. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app and access the Service for your personal educational use.

For apps obtained through the Apple App Store, this license is limited to use on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing rules.

The app and Service are licensed, not sold. We and our licensors retain all rights not expressly granted to you.

8. Intellectual Property

Bivia, the app, software, design, interface, branding, logos, lessons, explanations, flashcards, quizzes, images, question structures, study flows, audio, text, databases, and other content are owned by us or our licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, sell, rent, sublicense, scrape, extract, publish, translate, create derivative works from, or commercially exploit the Service or its content without our prior written permission, except as allowed by law.

You may use the Service for personal study. You may not use the Service to build competing datasets, training materials, applications, question banks, AI models, or commercial products.

9. User Data, Progress, and Preferences

The Service may store and process account data, study progress, responses, review history, settings, language preferences, subscription status, analytics events, crash reports, and related technical information to provide, maintain, personalize, secure, and improve the Service.

You are responsible for ensuring that any information you provide is lawful, accurate, and does not violate another person's rights.

10. Acceptable Use

You agree not to:

We may suspend or terminate access if we reasonably believe you violated these Terms, created risk, infringed rights, or used the Service abusively.

11. Offline Content

Paid plans may allow eligible users to download or cache certain lessons, images, questions, or study content for offline use. Offline access is provided for convenience only and does not transfer ownership of any content.

Offline content may be limited, removed, updated, or disabled if your subscription expires, is canceled, is refunded, cannot be validated, or if content is updated, corrected, removed, or no longer available.

12. Third-Party Services

The Service may rely on third-party services, platforms, and SDKs, such as Apple, Google, Supabase, Firebase, RevenueCat, app stores, payment processors, hosting providers, analytics providers, authentication providers, and support tools.

Your use of third-party services may be subject to their own terms and privacy policies. You agree to comply with applicable third-party terms when using the Service.

We are not responsible for third-party services, outages, account restrictions, billing systems, app store decisions, or third-party terms, except where required by applicable law.

13. App Store Terms and Apple-Specific Terms

If you downloaded the app from the Apple App Store, the following terms apply:

  1. These Terms are between you and us, not Apple. We are solely responsible for the app and its content.
  2. Apple has no obligation to provide maintenance or support services for the app.
  3. We are responsible for any maintenance and support services required by applicable law or described in these Terms.
  4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  5. We, not Apple, are responsible for addressing claims relating to the app or your use of the app, including product liability claims, legal or regulatory compliance claims, and claims under consumer protection, privacy, or similar laws.
  6. If a third party claims that the app or your possession or use of the app infringes intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and discharging the claim.
  7. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government prohibited or restricted party list.
  8. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

14. Updates and Availability

We may update the app and Service to add, change, or remove features, fix bugs, improve performance, comply with law, or address security and platform requirements. Some updates may be required for continued use.

We do not guarantee that the Service will be available at all times or free from errors, interruptions, data loss, or defects. We may suspend or limit the Service for maintenance, security, legal, operational, or technical reasons.

15. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, or error-free operation.

We do not warrant that educational content will be complete, current, suitable for your curriculum, accepted by any institution, sufficient for exams, or applicable to any clinical or professional situation.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer protection law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, academic outcomes, exam results, professional outcomes, clinical decisions, or damages arising from reliance on educational content.

To the maximum extent permitted by applicable law, our total liability for all claims relating to the Service will not exceed the amount you paid to us for the Service during the 12 months before the event giving rise to the claim, or USD 50, whichever is greater.

These limitations do not apply where prohibited by law, including liability that cannot be limited under applicable consumer law.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, and expenses arising from your misuse of the Service, violation of these Terms, unlawful conduct, infringement of rights, or use of the Service for diagnosis, treatment, clinical, or professional decision-making.

18. Termination

You may stop using the Service at any time. You may delete your account where available or contact support.

We may suspend or terminate your access if you violate these Terms, create risk for us or others, misuse subscriptions or payment systems, infringe rights, or if required by law or platform rules.

Termination does not automatically cancel an active app store subscription. You must cancel subscriptions through the applicable app store account settings.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, payment obligations, Apple-specific terms, governing law, and dispute provisions.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the app, website, or other appropriate means. The updated Terms will be effective when posted unless a later date is stated.

Your continued use of the Service after changes become effective means you accept the updated Terms. If you do not agree, you must stop using the Service and cancel any subscription through the applicable app store.

20. Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles, except where mandatory consumer protection laws in your country or region provide otherwise.

If you are a consumer in the European Union, United Kingdom, Switzerland, Brazil, or another jurisdiction with mandatory consumer rights, nothing in these Terms limits rights you cannot waive under applicable law.
